EXPLAINED

The New Jersey Buyer Agreement, Explained Before You Sign It.

Since the NAR settlement, New Jersey buyers sign a written representation agreement before touring homes. Most people are handed it on a doorstep and asked to sign. I would rather you read it here, at your kitchen table, with time to ask questions.

The 5 Terms in a New Jersey Buyer Agreement That Actually Matter

TermWhat to look for
LengthAnything from one showing to a year. If you have not worked with an agent before, start short — 30 to 90 days is entirely reasonable. Earn the renewal.
ScopeOne specific property, a named town, or all of New Jersey. A narrow scope protects you if you are interviewing more than one agent.
CompensationA stated percentage or flat fee. It must be a specific number, not “whatever the seller offers”. If the seller offers less, the gap becomes a negotiating item — we address it in the offer, not after.
ExclusivityExclusive means one agent for the covered scope. That is usually better for you — divided loyalty produces divided effort — but you should choose it knowingly.
TerminationHow you end it, and whether any protection period survives. Ask this question out loud before you sign. An agent who is uncomfortable answering it has told you something useful.

WHY THIS IS GOOD FOR YOU

An unwritten arrangement always favored whoever knew the rules.

Before the settlement, buyer-side compensation was buried in listing data most buyers never saw, and the relationship was defined by habit rather than by a document. Putting it in writing means you know what I owe you, what you owe me, and what it costs — before the emotional part starts. I have not lost a single client to this form. I have gained several who read it somewhere else and wanted a clearer explanation.

What I put in writing in return

General information, not legal advice. Your attorney can review any agreement before you sign — and should, if anything in it is unclear to you.
